Answers:    You can not get HIV from someone who does not have HIV. HIV does not appear out of nowhere when 2 people hold sex. One person has to have HIV for the other personality to get infected. That said, since HIV has no symptoms, you can't tell in recent times by looking at someone whether or not they have HIV, and someone who has HIV would not know that they have it unless they obtain tested. The only way for someone to find out if they have HIV is for them to take an HIV test.
The other issue in your question: Men have sex with other men. Of all sexual activity, anal sex have the highest risk of transmission of HIV (due to high risk of bleeding) so if one man have HIV, the other man has a high risk of being infected if they enjoy unprotected sex.
